Overview

 

Access to the Zaags application (hereinafter, the “Application”), navigation on it, and the use of the services provided by RUDLU Unip LDA are governed by the general conditions of use (“GT&C” ) detailed below. 

The Application is the exclusive property of RUDLU Unipessoal LDA, registered in Portugal with NIF 516730304, and whose registered office is located at 27a rua da Bela Vista a Graça, 1170-058, Lisboa, Portugal.

These terms & Conditions are also part of those of Zenn.cards and smartreview,app as the cards emitted by these sites are linked to Zaags’ apps.

Preamble

Any user of the Application acknowledges having read these GT&Cs and accepting them. Use of the Application implies unreserved acceptance of the GT&Cs, the Privacy Policy is an integral part of these General Terms & conditions, it is displayed separately for convenience only.

In the event of disagreement with all and any part of the GT&Cs, the user must immediately refrain from using the Application. 

RUDLU Unip LDA reserves the right to modify the terms of the GT&Cs at any time and without notice. 

Amendments are effective immediately upon posting of the amended terms on the Application.

If a condition was to be lacking in these GT&Cs, it will be considered to be governed by the practices in force in the distance selling sector and in accordance with Portuguese law. 

Failing to adhere to and respect  Zaags’ terms can result in restrictions of the functionality of cards like Zenn.cards or Smartreview.app cards.

Definitions

Application: refers to the mobile application(s) published and operated by RUDLU Unip LDA

Terms: refers to these General Terms and Conditions of use of the Application.

User Content: refers to the data transmitted by the User in the various sections of the Application.

Browsing data: refers to information related to the connection of your terminal to the Application. Zags is likely to use this navigation data for statistical purposes.

Personal data: refers to information related to Users. This may be the history of use of the Services by the User, geolocation data and registration data.

Partners: designates all the e-commerce sites or IT companies with which we have a direct or indirect partnership contract.

Services: refers to all the services, free or paid, accessible to Users.

User(s): designates one (or all) person(s) registered on the Zaags Application and also includes business owners.

Zaags : designates both the publisher and the application.

Access to services

The services offered by Zaags via the Application include, among others:

– adding and saving geolocated addresses,

– the storage of personal data & media for display in the App

– the identification of an address by its name, address, contact details, geolocation and tags defined by the User,

– the display of the location of the User and his registered addresses.

Services are accessible to any User with Internet access, fees may apply. All costs relating to access to the Services, whether hardware, software or internet access costs, are the sole responsibility of the user. He is solely responsible for the proper functioning of his equipment as well as his access to the Internet.

Zaags reserves the right to refuse access to the Services, unilaterally and without prior notification, to any User who does not comply with these terms of use. Zaags will have no obligation to maintain any information stored in its databases relating to your account or to transmit such information to you or any third party.

Zaags implements all reasonable means at its disposal to ensure quality access to the Services, but is under no obligation to do so.

Zaags cannot, moreover, be held responsible for any malfunction of the network or servers or any other event beyond reasonable control, which would prevent or degrade access to the Services.

Zaags reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Services, in order to ensure maintenance, or for any other reason, without the interruption giving rise to any obligation or indemnification.

User name

When setting up your Zaags app profile, selecting a username that respects all users and adheres to intellectual property rights is crucial. Your chosen username should not infringe on trademarks or copyrights, impersonate others, or be offensive. In case of disputes over your username’s appropriateness or Intelectual Property rights infringement, we may request a change or, if necessary, suspend or terminate your account. For inactive accounts with no activity for six months, we reserve the right to reclaim or reassign usernames, ensuring prior communication with the account holder.

Limitation of Liability

The User acknowledges having read and accepted these conditions, as well as having the skills to navigate the mobile application.

The User is solely responsible for the User Content that he puts online via the Services, as well as for the texts and/or opinions that he formulates. He undertakes in particular that this data is not of a nature to infringe the legitimate interests of third parties, whatever they may be. As such, it guarantees RUDLU Unip LDA against any recourse, based directly or indirectly on these remarks and/or data and/or media, likely to be brought by anyone against RUDLU Unip LDA. 

He undertakes in particular to take charge of the payment of sums, whatever they may be, resulting from the recourse of a third party against RUDLU Unip LDA, including lawyers’ fees and court costs.

Zaags reserves the right to delete all or part of the User Content, at any time and for any reason, without prior warning or justification. The User cannot make any claim in this regard.

Zaags reserves the right to exclude a User if his behavior on the Application is deemed not appropriate. Zaags also reserves the right to access, read, preserve or disclose any information it deems necessary to satisfy any law, regulation, legal process or governmental request for the purpose of enforcing these terms, including an investigation. about potential violations of these Terms, to detect, prevent, or report a fraud, security or technical problem, respond to user support requests, or protect the rights, property, or safety of Zaags, its users, and the audience.

The Application provides some information from sources believed to be reliable. However, Zaags cannot guarantee the accuracy or timeliness of this data. In addition, the information made available on the Application is for informational purposes only and does not in any way constitute advice or a recommendation of any kind.

Media

 

The use of the Application to store or send Media of any sort implies both the following:

  1 – having right to the media uploaded and/or sent.

   2 – the renunciation to exclusive copyrights to the said media, the latter can be reused by the business to whom it has been sent to and by zaags and its partner sites.

 

Wifi Login

 

Please note that the wifi password can be visible from users devices, inserting the password of your wifi router is similar to telling a customer the password.

Amendments

The information and/or documents available on the application are subject to change at any time, and may have been updated. In particular, they may have been updated between the time of their download and the time the User becomes aware of them.

Consequently, the use of the information and content available on the entire Application, can in no way engage the responsibility of RUDLU Unip LDA, in any capacity whatsoever. The User is solely responsible for the proper use, with discernment and spirit, of the information made available to him on the Application.

Zaags cannot be held responsible for disputes between users of the Services and Partners.

Use of the services

Furthermore, the User agrees to indemnify RUDLU Unip LDA for any harmful consequences directly or indirectly related to the use he makes of the Service.

RUDLU Unip LDA undertakes to put in place all the necessary means on a best effort basis to guarantee the security and confidentiality of the data transmitted.

The user understands his app may/will contain personal information that will be accessible to any person having the link(s) to the app, wheteher as a URL, a QR code or an NFC Tag. In addition it is stressed that the user’s app link may be guessed by anyone who will henceforth have access to the app data.

The User acknowledges knowing the limitations and constraints specific to the Internet network and, as such, acknowledges in particular the impossibility of a total guarantee of the security of data exchanges. RUDLU Unip LDA cannot be held liable for damages resulting from the transmission of any information, including that of its username and/or password, via the Service.

RUDLU Unip LDA cannot under any circumstances, within the limits of applicable law, be held liable for damages and/or prejudice, direct or indirect, material or immaterial, or of any nature whatsoever, resulting from the unavailability of the Service or any Use of the Service. The term “Use” must be understood in the broad sense, that is to say any use of the site whatsoever, legal or not.

The User undertakes, in general, to respect all regulations in force in Portugal, his own residency country and the country from which he accesses the application(s).

By submitting content to your Zaags profile, you hereby grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, publicly display, distribute, modify, adapt, and create derivative works from your content. This license also extends to the use of your name, image, voice, photograph, likeness, and any personal attributes contained within the content, for the purposes of display on the Platform and in our marketing efforts across all media forms, including but not limited to our social media channels and other forms of advertising. You acknowledge that this license allows us to utilize your content globally, without the obligation to compensate you, and for an indefinite period.

You shall maintain ownership and all applicable rights to your content. It is important to recognize that once content is made available on your Zaags profile, it becomes publicly accessible and may be used and shared by others both on Zaags and throughout the internet.

We urge you not to disclose any personal information on Zaags that you wish to keep private. Specifically, avoid posting sensitive details such as social security numbers, passport information, or any other data that could be detrimental if acquired by unauthorized parties. You may only share another individual’s personal information with their explicit consent and provided that you maintain a record of such consent.

While we are not obligated to monitor the content for accuracy, reliability, or legality, we reserve the right to do so at our discretion. We also retain the authority to modify, remove, or restrict access to any content that violates these Terms, or to apply a sensitive content warning to any material deemed inappropriate for general audiences.

 

Personal data and confidentiality

The personal data collected on Zaags is collected in agreement with the User and is intended to improve his experience on the Application or via the Services. 

Zaags reserves the right to collect various personal and non-personal data, including through the collection of cookies, in an effort to improve the customer experience and the ergonomics of the Application and the Services, analyzes statistics and personalization of the Services.

When you enter data in a personal or business app, you acknowledge the fact that Zaags or affiliate sites such as zenn.cards or smartreview.app will display as part of their service this information via your app. 

Would you request a withdrowal of this data, we draw your attention to the fact that the app or the cards associated might cease functioning properly. In such event, Zaags and associated sites are deny any responsibility.

Zaags may be required to communicate user information anonymously in a rental / sale / database provision process after prior agreement with the user.

Business data included in the app can be derived from publicly available data or submited by business owners. Zaags does not guarantee the accuracy or timeliness of this data which is provided as informational.

The Application may also include targeted advertisements and offers. The types and extent of advertising are subject to change. In return for Zaags providing you with access to use its Services, you agree that Zaags, or its third party suppliers and partners, may place advertising on the Application.

Copyright and intellectual property

The application and all of its content are subject to European and international legislation on copyright and intellectual property. The general structure of the Application, as well as the texts, graphics, images, sounds and videos composing it, are the property of RUDLU Unip LDA or its partners. Any representation and/or reproduction and/or partial or total exploitation of the content and services offered by the Application, by any process whatsoever, without the prior written authorization of RUDLU Unip LDA is strictly prohibited and could constitute a infringement to the Intellectual Property Code.

The texts, graphics, images, sounds and videos downloaded and/or imported into the Application by the Users remain the property of their authors who unconditionally give Zaags the rights to use them within the application(s).

Similarly, any owner of a website, whether personal  or professional, must obtain prior agreement with RUDLU Unip LDA to place links to the Application or the Services, only direct links as provided by Zaags may be included in websites. No modification, addition to the links are permitted.. RUDLU Unip LDA cannot be associated with any user using techniques such as framing, embedding or inline linking. Any link pointing to the Application must be removed at Zaags’s request.

Links

Zaags offers links to websites published and/or managed by third parties. Insofar as no control is exercised over these external resources, the User acknowledges that Zaags assumes no responsibility relating to the provision of these resources, and cannot be held responsible for their content.

Applicable law and competent jurisdiction

The legal rules applicable to content and data transmissions on and around the site are determined by Portuguese law. In the event of a dispute, which could not be the subject of an amicable agreement, only the Portuguese courts within the jurisdiction of the Lisbon Court of justice are competent.
